Reporting illegal content

Following the legal provisions of article 6-I-7 of the Law n°2004-575 of June 21 2004 on confidence in the digital economy HOSTEUR cannot supervise the entirety of the contents and the Internet sites which it hosts in order to determine their licit character or not.

In response to these legal provisions HOSTEUR has deployed a simple system allowing any person to report to the company any content likely to have the characteristics of the offences referred to in the fifth and eighth paragraphs of Article 24 of the Law of 29 July 1881 on the freedom of the press and in Article 227-23 of the Criminal Code namely the offences:

In order to process your request as soon as possible please indicate in your e-mail :

• The date on which the offence was detected
• The precise address(es) (URL) from which the content(s) is/are accessible *
• a detailed description of the content you consider to be illegal (and a copy of that content);
• Your name and complete address (HOSTEUR guarantees the confidentiality of the transmitted information as well as a right of access in accordance with the Data-processing law and Freedom of January 6 1978).

Finally any misuse of the system for purposes other than those stipulated above may be subject to prosecution and imprisonment in accordance with Article 6.4 of Law n°2004-575 for confidence in the digital economy:

"The fact for any person of presenting to the persons mentioned in 2 ( hosting providers) a content or an activity as being illicit with the aim of obtaining its withdrawal or stopping its dissemination when he/she knows this information to be inaccurate is punishable by one year's imprisonment and a fine of €15000 (EUROS). "
